ALCANCE<o:p><\/o:p><\/span><\/b><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Esta pol\u00edtica se aplica a:<o:p><\/o:p><\/span><\/p><ul type=\"disc\" style=\"margin-bottom: 0cm; color: rgb(0, 0, 0); font-size: medium; margin-top: 0cm;\"><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Clientes que han contratado servicios de la plataforma GOEVO;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Usuarios autorizados por la PARTE CONTRATANTE;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Administradores, gerentes y dem\u00e1s personas que utilicen la Plataforma con credenciales v\u00e1lidas.<o:p><\/o:p><\/span><\/li><\/ul><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">El uso de la Plataforma implica la aceptaci\u00f3n plena de esta Pol\u00edtica, vinculada al Acuerdo de Software como Servicio (SaaS) celebrado entre las Partes.<o:p><\/o:p><\/span><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">&nbsp;<\/span><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><b><span style=\"font-size: 12pt; line-height: 17.12px;\">3. USO PERMITIDO DE LA PLATAFORMA<o:p><\/o:p><\/span><\/b><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">La plataforma GOEVO podr\u00e1 utilizarse exclusivamente para:<o:p><\/o:p><\/span><\/p><ul type=\"disc\" style=\"margin-bottom: 0cm; color: rgb(0, 0, 0); font-size: medium; margin-top: 0cm;\"><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Actividades internas y leg\u00edtimas relacionadas con el negocio de la PARTE CONTRATANTE;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Fines compatibles con el alcance, el plan, las m\u00e9tricas y las condiciones contractuales;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Aplicaci\u00f3n de la Plataforma a los procesos y normas de negocio del CLIENTE, dentro de los l\u00edmites acordados.<o:p><\/o:p><\/span><\/li><\/ul><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">El uso debe respetar:<o:p><\/o:p><\/span><\/p><ul type=\"disc\" style=\"margin-bottom: 0cm; color: rgb(0, 0, 0); font-size: medium; margin-top: 0cm;\"><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">El contrato SaaS;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Condiciones del contrato (formulario de pedido);<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Los T\u00e9rminos de Servicio y Proyectos aplicables a la Plataforma GOEVO, si los hubiere;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Esta es una pol\u00edtica de uso.<o:p><\/o:p><\/span><\/li><\/ul><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">&nbsp;<\/span><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><b><span style=\"font-size: 12pt; line-height: 17.12px;\">4. RESPONSABILIDADES DE LA PARTE CONTRATANTE<o:p><\/o:p><\/span><\/b><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">La PARTE CONTRATANTE es totalmente responsable de:<o:p><\/o:p><\/span><\/p><ul type=\"disc\" style=\"margin-bottom: 0cm; color: rgb(0, 0, 0); font-size: medium; margin-top: 0cm;\"><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Para garantizar que sus usuarios utilicen la Plataforma de conformidad con esta Pol\u00edtica;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Definir y gestionar perfiles, accesos y permisos;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Mantenga la confidencialidad de las credenciales de acceso;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Aseg\u00farese de que los datos introducidos sean legales, exactos y le pertenezcan;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Notifique inmediatamente a GOEVO cualquier uso indebido, acceso no autorizado o incidente de seguridad.<o:p><\/o:p><\/span><\/li><\/ul><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">&nbsp;<\/span><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><b><span style=\"font-size: 12pt; line-height: 17.12px;\">5. Usos prohibidos<o:p><\/o:p><\/span><\/b><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">La PARTE CONTRATANTE y sus usuarios tienen expresamente prohibido:<o:p><\/o:p><\/span><\/p><ul type=\"disc\" style=\"margin-bottom: 0cm; color: rgb(0, 0, 0); font-size: medium; margin-top: 0cm;\"><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Compartir el acceso o permitir su uso por terceros no autorizados;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Utilizar la Plataforma con fines ilegales o fraudulentos, o en violaci\u00f3n de los derechos de terceros;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Realizar ingenier\u00eda inversa, copiar, modificar o intentar acceder al c\u00f3digo fuente;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Introducir virus, scripts maliciosos o cualquier elemento que comprometa la seguridad;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Utilizar la Plataforma de forma que se degrade su rendimiento, disponibilidad o integridad;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Utilizar la Plataforma para el desarrollo de una soluci\u00f3n competidora o para su explotaci\u00f3n no autorizada.<o:p><\/o:p><\/span><\/li><\/ul><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">&nbsp;<\/span><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><b><span style=\"font-size: 12pt; line-height: 17.12px;\">6. SEGURIDAD Y CONTROLES DE ACCESO<o:p><\/o:p><\/span><\/b><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">GOEVO adopta medidas t\u00e9cnicas y administrativas razonables para proteger la Plataforma.<o:p><\/o:p><\/span><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">El CLIENTE reconoce que la seguridad del entorno tambi\u00e9n depende de la correcta gesti\u00f3n de los usuarios, las contrase\u00f1as y los accesos bajo su responsabilidad.<o:p><\/o:p><\/span><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">&nbsp;<\/span><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><b><span style=\"font-size: 12pt; line-height: 17.12px;\">7. DATOS Y CONTENIDO INTRODUCIDOS<o:p><\/o:p><\/span><\/b><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Los datos, la informaci\u00f3n y el contenido introducidos en la Plataforma son responsabilidad exclusiva de la PARTE CONTRATANTE.<o:p><\/o:p><\/span><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">El tratamiento de los datos personales cumplir\u00e1 con lo dispuesto en el Acuerdo de Tratamiento de Datos Personales (ATDP), de conformidad con la Ley N\u00b0 13.709\/2018 (LGPD).<o:p><\/o:p><\/span><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">&nbsp;<\/span><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><b><span style=\"font-size: 12pt; line-height: 17.12px;\">8. MEDIDAS EN CASO DE MAL USO<o:p><\/o:p><\/span><\/b><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">En caso de incumplimiento de esta Pol\u00edtica, GOEVO podr\u00e1, proporcionalmente y seg\u00fan la gravedad:<o:p><\/o:p><\/span><\/p><ul type=\"disc\" style=\"margin-bottom: 0cm; color: rgb(0, 0, 0); font-size: medium; margin-top: 0cm;\"><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Notificar a la PARTE CONTRATANTE para que realice la correcci\u00f3n;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Suspender temporalmente el acceso a la Plataforma;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Bloquear usuarios espec\u00edficos;<o:p><\/o:p><\/span><\/li><li style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif;\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Rescindir el contrato, de conformidad con los t\u00e9rminos estipulados en el mismo.<o:p><\/o:p><\/span><\/li><\/ul><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">Siempre que sea posible, GOEVO procurar\u00e1 comunicarse con antelaci\u00f3n, sin perjuicio de las medidas inmediatas que se puedan adoptar en situaciones cr\u00edticas.<o:p><\/o:p><\/span><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><span style=\"font-size: 12pt; line-height: 17.12px;\">&nbsp;<\/span><\/p><p style=\"margin: 0cm; line-height: 15.6933px; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><b><span style=\"font-size: 12pt; line-height: 17.12px;\">9.
